Cyber-Dyne, Inc. does not review specific requests for guidance pertaining to the use of its trademarks or product names. Therefore, Cyber-Dyne, Inc. will not respond to requests to review such matters, including proposed names or titles, product packaging, advertising, domain names, marketing materials or other collateral. If your request falls outside this scope, please consult your legal counsel.

Without waiving any of its rights, Cyber-Dyne, Inc. does not advise others on the scope of its intellectual property rights. Cyber-Dyne, Inc. does not permit or consent to any name, logo, trademark or any other device that could be confused with or could dilute its trademarks. Definitions
A trademark is a word, name, symbol, phrase, or logo that is used to identify goods made by a company and to distinguish those products from goods produced or sold by others. A service mark is used to identify services rather than goods (both types of marks will be referred to as "trademarks").  A trade name is the name under which a company does business. Trade dress means the overall commercial impression of the packaging for a product, including the package size, shape, color, design and texture as well as the mark used. Trademark law does prevent trading off another company's trade dress.

TM vs. ®
Trademark rights are acquired by the proper, continuous use of the trademark. A trademark that has not been registered with the Trademark Office is noted with a TM . Registered trademarks are noted with a ®. Although specific permission is not required for referential use, Cyber-Dyne, Inc. does request that you use our trademarks and registered trademarks correctly and refer to them properly. Proper reference includes marking them with the appropriate trademark symbol (® or TM) and using the correct product descriptor. You should refer to the full product name and mark our trademark(s) completely at the first and most prominent reference, or as soon as practicable thereafter.

Referential Use
You may generally use Cyber-Dyne, Inc. trademarks or product names to refer specifically to Cyber-Dyne, Inc. products. Cyber-Dyne, Inc. does not object to your making referential use of our trademarks or product names in advertising, in books and other printed matter, on clothing or other promotional items, on-line and Internet locations, at public exhibitions or demonstrations, in your own software applications, in television programs / commercials / movies, and/or in video tapes; provided you follow our trademark guidelines; and provided the use is not disparaging. Your use must not mislead the public as to Cyber-Dyne, Inc. sponsorship, affiliation or endorsement of your company, or your products or services.

Titles
Microsoft does not review or specifically grant permission to use its trademarks in book titles, series titles, website titles or other titles. Publishers should consult their own legal counsel regarding proper referential use of others' trademarks in their titles. Titles that refer to Cyber-Dyne, Inc. trademarks are generally appropriate so long as: (1) the Cyber-Dyne, Inc. trademark does not appear as the first word or otherwise as the most prominent part of the title; (2) the Cyber-Dyne, Inc. trademark is not used in any other manner that might suggest Cyber-Dyne, Inc. affiliation, sponsorship or certification; (3) the book cover does not include any Cyber-Dyne, Inc. logos, logotypes, icons, trade dress or other designs; (4) the book includes a prominent disclaimer of association with Cyber-Dyne, Inc.; and (5) Cyber-Dyne, Inc. trademarks are properly marked with the appropriate TM or ® symbol and attributed to Cyber-Dyne, Inc.

Domain Names
Cyber-Dyne, Inc. does not allow third parties to use "HySecure"e; "HoustonBizPages", "E-ComWorks" or any other Cyber-Dyne, Inc. product names in their internet domain name. Because the purpose of trademarks is to identify the source of a product, if Cyber-Dyne, Inc. trademarks were combined with the trademarks, product names or internet domain names of others, consumers or Internet users may be confused as to which company is the source of a product or web site.

In Company Names, Product Names or Names of Services
You may not include or incorporate, in whole or in part, any Cyber-Dyne, Inc. trademarks into your company name or the name of your products or services. For example, you may not include "E-ComWorks" or any potentially confusing variation in the name of your product, company name or service and this same rule applies to any other Cyber-Dyne, Inc. trademarks.
